DELUDE IL TESTO BASE SULLA RIDUZIONE DEI TEMPI PER OTTENERE IL DIVORZIO DEPOSITATO IN COMMISSIONE GIUSTIZIA
Di seguito riportiamo il testo base depositato dal relatore Paniz (Pdl) in Commissione Giustizia (seduta del 13 aprile 2010 consultabile anche nella sezione "In Commissione Giustizia" posta all'interno del Menu principale) e il conseguente comunicato stampa diramato congiuntamente dalla deputata radicale eletta nel PD, on.le Rita Bernardini, e della Lega Italiana per il Divorzio Breve
Disposizioni in materia di separazione giudiziale tra i coniugi. C. 749 Paniz, C. 1556 De Angelis e C. 2325 Amici.
PROPOSTA DI TESTO UNIFICATO DEL RELATORE
Art. 1.
1. Al secondo capoverso della lettera b) del numero 2) del comma 1 dell'articolo 3 della legge 1o dicembre 1970, n. 898, e successive modificazioni, sono apportate le seguenti modifiche:
a) al primo periodo le parole: «tre anni» sono sostituite dalle seguenti: «un anno»;
b) dopo il primo periodo è inserito il seguente: «in caso di presenza di figli minori, il termine di cui al periodo precedente è di due anni»
Art. 2.
1. All'articolo 191 del codice civile è aggiunto, in fine, il seguente comma:
«Nel caso di separazione personale, la comunione tra i coniugi si scioglie nel momento in cui, in sede di udienza presidenziale, il presidente autorizza i coniugi a vivere separati».

(ANSA) - ROMA, 14 APR - 'Il Testo Base sul Divorzio Breve presentato ieri in Commissione Giustizia dal relatore Paniz costituisce l'ennesimo compromesso al ribasso e discrimina fortemente chi non e' religioso e chi non ha figli'. Lo affermano, in una nota congiunta, Rita Bernardini, deputata radicale eletta nelle liste del PD, membro della Commissione Giustizia della Camera, e l'avvocato Alessandro Gerardi, Tesoriere della Lega Italiana per il Divorzio Breve.
'L'articolato, com'era prevedibile, strizza l'occhio alle pretese illiberali del clero cattolico non riconoscendo - sottolineano - la possibilita' alla coppia di chiedere e ottenere direttamente il divorzio, senza passare attraverso un preventivo quanto inutile periodo di separazione legale. Inoltre e' discriminatorio laddove riduce il termine interlocutorio di separazione a un anno per chi non ha figli minori, mentre in caso contrario lo porta a due. E' appena il caso di ricordare che in questa legislatura i radicali eletti nel gruppo del PD hanno presentato una proposta di legge davvero risolutiva con la quale viene stabilito un principio per noi irrinunciabile ossia che, in alternativa alla separazione, per la coppia in crisi irreversibile il divorzio deve poter essere possibile fin da subito'.
'La Commissione Giustizia, a maggioranza dei suoi membri, ha deciso, in modo alquanto discutibile, di non calendarizzare insieme agli altri quel nostro disegno di legge a prima firma Farina Coscioni. Ora pertanto - concludono - non ci resta che tentare di migliorare, per quanto possibile, questo testo base presentato dal relatore Paniz, consapevoli del fatto che oramai i cittadini interessati al divorzio non accettano piu' il significato della separazione'. Lo dicono Rita Bernardini, deputata radicale eletta nelle liste del Pd, e l'avvocato Alessandro Gerardi, tesoriere della Lega italiana per il divorzio breve, che aggiungono: "L'articolato, com'era prevedibile, strizza l'occhio alle pretese illiberali del clero cattolico, non riconoscendo la possibilita' alla coppia di chiedere e ottenere direttamente il divorzio, senza passare attraverso un preventivo quanto inutile periodo di separazione legale. I radicali eletti nel gruppo del Pd hanno presentato una proposta di legge con la quale viene stabilito il principio per cui, "in alternativa alla separazione, per la coppia in crisi irreversibile il divorzio deve poter essere possibile fin da subito, ma la commissione Giustizia - conclude Bernardini - a maggioranza dei suoicomponenti, ha deciso di non calendarizzarla insieme agli altri". Roma, 14 apr. (Apcom) - Riparte alla Camera l'iter del 'divorzio breve'. Maurizio Paniz, deputato del Pdl, ha svolto oggi la sua relazione generale in commissione Giustizia alla Camera sulla legge che dovrebbe rendere possibile anche in Italia il cosiddetto divorzio breve: in sintesi, per sciogliere un matrimonio di fronte alla legge, si dovrà aspettare in genere un anno, due se oltre alla coppia saranno componenti della famiglia anche figli minorenni. "Questo testo - spiega Paniz - è la sintesi delle varie proposte di legge presentate alla Camera sull'argomento. E mi sembra che trovi condivisione in gran parte delle forze politiche".
L'ultimo tentativo di mettere mano alla normativa sulla famiglia è di sette anni fa, quando lo stesso Paniz provò a presentare una analoga norma. Contraria alla norma la deputata radicale Rita Bernardini. "Il testo base sul divorzio breve - afferma - costituisce l'ennesimo compromesso al ribasso e discrimina fortemente chi non è religioso e chi non ha figli".
