Divorzi, i giudici non ci stanno «La legge? È meglio cambiarla»

Migliaia di divorzi all’anno, sfornati a ritmo di record dalla nona sezione civile del tribunale di Milano, con grande soddisfazione di giudici, avvocati, e dei tanti milanesi in attesa di sciogliere il loro matrimonio. Peccato che - come raccontato ieri dal Giornale - questa ammirevole efficienza produttiva passi attraverso una vistosa forzatura del codice di procedura civile: anziché davanti ai tre giudici previsti dalla legge, le udienze di divorzio consensuale si tengono davanti ad un solo magistrato. Gli altri due giudici nel frattempo tengono ciascuno altre udienze, e il terzetto si ricompone a fine giornata solo per mettere le firme in fondo alle sentenze. Un piccolo falso a fin di bene, che però potrebbe mettere le sentenze a rischio di annullamento.
Tutti fuorilegge, dunque, i divorzi dei milanesi? Gloria Servetti, presidente della nona sezione civile, la sezione specializzata in diritto di famiglia, non ci sta: «Si tratta di una prassi - spiega la dottoressa, la stessa che dovrà decidere sulla separazione tra Silvio Berlusconi e Veronica Lario - che in questo tribunale viene applicata da moltissimo tempo: dal 1988, direi, forse addirittura dalla fine del 1987. Ed è rimasta in vigore senza interruzioni, sotto la presidenza di diversi validi magistrati». Il fatto che il «rito ambrosiano» sia in vigore da più di vent’anni, però, non elimina i dubbi sulla sua fedeltà al codice civile... «Il codice - risponde Gloria Servetti - prevede che i divorzi richiesti congiuntamente vengano esaminati e decisi da un collegio di tre giudici. E questo è esattamente quel che accade. Se poi materialmente i tre giudici sono seduti in stanze diverse non mi sembra un problema decisivo».
In realtà, come al sesto piano del palazzo di giustizia sanno tutti, la partecipazione dei giudici alla decisione è una pura finzione: i coniugi compaiono davanti ad un solo giudice, un solo giudice li dichiara divorziati, grazie e arrivederci. È assolutamente vero, peraltro, che il sistema data da molti anni a questa parte, e che punta ad aggirare una norma del codice troppo farraginosa. Ma allora non sarebbe preferibile cambiare il codice, anziché fare come se non esistesse? «Certamente - risponde un magistrato che ha lavorato alla nona sezione civile e che non vuole essere citato -sarebbe più logico che il codice prevedesse, nei casi di ricorso congiunto, un giudice monocratico».
«Anche io - continua lo stesso magistrato - ho utilizzato questa prassi che, va ricordato, ha come unico obiettivo rendere un servizio migliore al cittadino, esaminando e decidendo in una giornata il triplo delle cause che potrebbero essere affrontate se i tre giudici stessero davvero tutti insieme».
Sì, vabbè, ma il codice civile per ora prevede tutt’altro. «Finora non mi risulta che si sia mai lamentato nessuno. Si tenga presente che questa soluzione viene adottata unicamente nei divorzi consensuali, dove non c’è in realtà assolutamente nulla da decidere. Non c’è da tentare di rappacificare i coniugi, visto che sono già separati da tempo. Non c’è da discutere sulle condizioni del divorzio, perché all’udienza i due coniugi arrivano già con l’accordo fatto, già trascritto su un modulo, e spesso assistiti da uno stesso avvocato. Insomma, al tribunale non resta di solito che verificare la legittimità dell’accordo e ratificarlo. Se queste ratifiche avvengono a fine giornata, a raffica, tutte insieme, non mi penso che questo costituisca chissà quale illegalità».
