Milano, le cause di divorzio sono tutte «fuorilegge»

I milanesi che divorziano sempre di più, le risorse della giustizia che sono quello che sono. Per fare fronte all’ondata di richieste, il tribunale di Milano ha instaurato da tempo una sorta di rito ambrosiano, che indubbiamente accelera di molto lo smaltimento delle pratiche. Peccato che si tratti di un sistema adottato in violazione di quello che prevede la legge, e falsificando i verbali di udienza. Dove il codice civile prevede la presenza di tre giudici, in realtà ce n’è uno solo. Gli altri passano a fine giornata, a mettere la firma, dichiarando di avere preso parte a una udienza cui in realtà non hanno mai messo piede. Il sistema va avanti così da anni, con soddisfazione di tutti: avvocati, giudici, e soprattutto dei cittadini che grazie al «rito ambrosiano» vedono ridursi molto i tempi di attesa. Ma è sufficiente questo a rendere il rito rispettoso della legge?
A pronunciarsi sulle istanze di separazione e divorzio a Milano è la nona sezione civile del tribunale. Pochi giorni fa sul Corriere della sera, Cesare Rimini - avvocato, specializzato in diritto di famiglia - ha segnalato con soddisfazione il record di 263 divorzi consensuali in un giorno stabilito dalla nona sezione. Ma è evidente che neanche con tutta la buona volontà del mondo si sarebbe potuto raggiungere un risultato simile se a tenere l’udienza fosse stato davvero - come prevede il codice - un tribunale collegiale, in cui ogni pratica venisse esaminata da tre giudici.
Apparentemente, margini di interpretazione la legge non ne lascia. Il codice civile stabilisce che nei casi di ricorso congiunto, presentato da coniugi che hanno già raggiunto un accordo non solo sulla scelta di lasciarsi ma anche sulle condizioni dello scioglimento, il ricorso venga indirizzato «al tribunale in camera di consiglio». Viene a quel punto fissata una udienza e nominato un giudice relatore. E a questo punto, dice sempre il codice civile, «il tribunale, sentiti i coniugi, decide con sentenza». Il tribunale: e dunque tre magistrati. Altrimenti la norma direbbe: il giudice.
Ora, come può agevolmente testimoniare chiunque abbia avuto occasione di divorziare a Milano in questi anni, non accade praticamente mai che i coniugi si trovino davanti più di un magistrato. È un solo magistrato a tenere l’udienza ed è solo quel medesimo magistrato a pronunciare la sentenza di divorzio. Che viene solo letta: la copia è messa a disposizione degli ex coniugi solo qualche giorno dopo, in cancelleria. E a quel punto, in fondo al foglio, sono comparse le firme di altri due giudici, che in udienza non si sono visti, ma che firmano ugualmente come se ci fossero stati.
Va ribadito: è tutto a fin di bene. Nel momento in cui il magistrato uno e trino teneva udienza nella sua stanza, ciascuno dei suoi colleghi teneva altre udienze ed emetteva altre sentenze, destinate anch’esse a venire firmate a fine giornata dai colleghi.
Il problema è che si tratta di divorzi - tecnicamente parlando - falsi: allo stesso modo in cui sarebbe priva di validità una sentenza emessa in un processo penale, da un tribunale composto da un giudice solo invece che da tre come prevede la legge. La differenza è che nelle udienze di divorzio tutti i protagonisti del processo hanno interesse a non fare troppe storie, in dieci minuti si chiude una storia d’amore, e avanti un altro. Ma cosa accadrebbe se dopo qualche tempo uno dei due ci ripensasse, e chiedesse di cancellare il divorzio basandosi proprio sul fatto che la sentenza non rispecchia affatto quel che è davvero successo in udienza?

In realtà, il «rito ambrosiano» ha trovato una soluzione anche per questo: in caso di divorzio congiunto, tra le formulette di rito che vengono firmate al momento dell’udienza ce n’è una con la quale marito e moglie rinunciano formalmente a presentare appello contro la sentenza. Vietato ripensarci, quindi. Vietato ripensare agli alimenti, all’amore che non c’è più, all’affidamento dei figli. E anche a quelle tre firme miracolosamente comparse su una sentenza emessa da un giudice solo.
