DIVORZIO, ADDIO TRIBUNALE: DAL NOTAIO SE SENZA FIGLI

Separarsi dal notaio anziché in tribunale, ma solo se non ci sono figli minorenni da tutelare. Si tratta di una ipotesi per snellire la giustizia civile su cui sta lavorando il Consiglio nazionale del notariato in concerto con il ministro della Giustizia. Alfano ha lanciato ieri la proposta per individuare nuove competenze da assegnare ai notai, per potere così alleggerire il lavoro dei tribunali civili. Tra le proposte possibili ci sarebbe, stando a quanto scrive il Corriere della sera, la "composizione patrimoniale nel caso delle separazioni senza figli", e, con una legge apposita, anche l'intera separazione dal notaio. "I dati dimostrano che laddove come categoria siamo stati chiamati a coadiuvare i giudici, le cose hanno funzionato bene", ha detto Giancarlo Laurini, presidente del Consiglio dei notai. "Noi non rappresentiamo interessi di parte - ha aggiunto al Corriere - sarebbe semplice affidarci il ruolo della composizione nelle separazioni". Dal Ministero arrivano conferme: i tecnici hanno detto che allo studio "ci sono varie ipotesi" per snellire le procedure civili. "I notai hanno le competenze adatte", hanno fatto sapere da via Arenula.

BERNARDINI DE PACE: "NON E' UN ROGITO" «La separazione non è un rogito e in questa materia l'esperienza giuridica, umana e psicologica contano più di ogni altra cosa». Non piace ad Annamaria Bernardini De Pace, noto avvocato matrimonialista, l'ipotesi di mettere fine alle nozze, quando non ci siano figli da tutelare, non più davanti a un giudice ma a un notaio. Alla proposta lanciata dal ministro Angelino Alfano insieme al Consiglio nazionale del notariato per cercare di accorciare i tempi della giustizia civile, Annamaria Bernardini De Pace è «fermamente contraria» perchè sarebbe come «farsi operare al cuore da un medico che non è un cardiochirurgo esperto». Senza togliere nulla alla loro professionalità «ritengo che i notai non abbiano l'esperienza per gestire il momento preparatorio» perchè « fare una separazione non vuol dire solo ratificare, ma è necessario portare i due coniugi a superare i conflitti e, se c'è, a dividere il patrimonio nei termini di giustizia». Che poi il notaio «ratifichi» la spartizione di un patrimonio o il trasferimento di immobili «va bene, ma accade già adesso», poichè ha competenze che la magistratura tempo fa gli ha trasferito. «Quindi - prosegue l'avvocato - non perderebbero i loro clienti» Quanto all'esigenza di accorciare i tempi il legale rilancia: «E se si facesse fare tutto a noi avvocati per poi depositare nella cancelleria del tribunale?». Inoltre precisa che gli avvocati in Italia «sono 250 mila mentre i notai molto meno» e, dunque, per la coppia ci sarebbe meno da attendere «meno file». Quel che Annamaria Bernardini vuole sottolineare è il ruolo centrale degli avvocati, in particolare quelli specializzati in questa materia, in quanto «hanno un'esperienza sul campo molto maggiore. La separazione - ribadisce - non è un fatto banale, ma è un momento rivoluzionario della vita di chiunque sotto il profilo sia affettivo sia patrimoniale». In più, aggiunge, «si corre il rischio che il più 'potentè e il più ricco tra i due coniugi obblighi l'altro ad andare da un notaio per chiudere, magari anche con un ricatto». Insomma per l'avvocatessa «non ci si può improvvisare da un giorno all'altro giudici della separazione. C'è un archivio di emozioni che non può essere trascurato e ci vogliono competenze ed esperienze. Pertanto - conclude - non vanno bene nè i notai e nemmeno gli avvocati che si occupano di altre materie. Altrimenti si va incontro ad equivoci, prendono spazio la voglia di litigare e le incomprensioni tra marito e moglie», con le conseguenze che ciò comporta, perchè mettere fine a un matrimonio non è come sottoscrivere «un rogito».
