SEPARAZIONE DAL NOTAIO: LA LEGA ITALIANA PER IL DIVORZIO BREVE GIUDICA POSITIVAMENTE L'INIZIATIVA DEL MINISTRO ALFANO
(ANSA) - ROMA, 3 LUG - L'idea a cui sta lavorando il ministro Alfano di trasferire ai notai le competenze in materia di separazione dei coniugi 'e' condivisibile, anche perche' se un matrimonio fallisce e non ci sono figli, in via consensuale tutto si risolve in un mero accordo economico, quindi perche' non ricorrere al notaio?'. Lo afferma in una nota Alessandro Gerardi, membro del comitato nazionale dei Radicali Italiani e tesoriere della Lega italiana per il Divorzio Breve.
Una pratica gestita dal notaio, spiega Gerardi, 'si risolverebbe in due o tre sedute al massimo. Ma e' anche una proposta coerente perche' in linea con il trend di outsourcing di molta della nostra giustizia, basti pensare ad alcune attivita' giurisdizionali delegate come le esecuzioni immobiliari e le omologhe degli atti societari, prima di competenza esclusiva della magistratura ed ora passate ai notai con un risparmio netto di un decimo sui tempi della giustizia civile'.
'Si tratta quindi - rileva - di una riforma a costo zero che produrrebbe una serie di immediati effetti benefici per il nostro comatoso sistema giudiziario in termini di numero di procedimenti iscritti, definiti e pendenti e in termini di budget allocato dallo Stato per il funzionamento della macchina giudiziaria civile. Cio' detto noi della Lega Italiana per il Divorzio Breve restiamo convinti del fatto - afferma ancora Gerardi - che in Italia il problema dei tempi lunghi per ottenere lo scioglimento del vincolo coniugale possa essere risolto definitivamente solo riconoscendo alla coppia in crisi la possibilita', se lo vuole, di chiedere e ottenere direttamente il divorzio, senza passare - conclude - attraverso un preventivo quanto inutile periodo di separazione legale, proprio come avviene in tutti gli altri Paesi europei'. 'La separazione non e' un rogito e in questa materia l'esperienza giuridica, umana e psicologica contano piu' di ogni altra cosa'. Non piace ad Annamaria Bernardini De Pace, noto avvocato matrimonialista, l'ipotesi di mettere fine alle nozze, quando non ci siano figli da tutelare, non piu' davanti a un giudice ma a un notaio. Alla proposta lanciata dal ministro Angelino Alfano insieme al Consiglio nazionale del notariato per cercare di accorciare i tempi della giustizia civile, Annamaria Bernardini De Pace e' 'fermamente contraria' perche' sarebbe come 'farsi operare al cuore da un medico che non e' un cardiochirurgo esperto'. Senza togliere nulla alla loro professionalita' 'ritengo che i notai non abbiano l'esperienza per gestire il momento preparatorio' perche' ' fare una separazione non vuol dire solo ratificare, ma e' necessario portare i due coniugi a superare i conflitti e, se c'e', a dividere il patrimonio nei termini di giustizia'.
Che poi il notaio 'ratifichi' la spartizione di un patrimonio o il trasferimento di immobili 'va bene, ma accade gia' adesso', poiche' ha competenze che la magistratura tempo fa gli ha trasferito. 'Quindi - prosegue l'avvocato - non perderebbero i loro clienti' Quanto all'esigenza di accorciare i tempi il legale rilancia: 'E se si facesse fare tutto a noi avvocati per poi depositare nella cancelleria del tribunale?'. Inoltre precisa che gli avvocati in Italia 'sono 250 mila mentre i notai molto meno' e, dunque, per la coppia ci sarebbe meno da attendere 'meno file'. Quel che Annamaria Bernardini vuole sottolineare e' il ruolo centrale degli avvocati, in particolare quelli specializzati in questa materia, in quanto 'hanno un'esperienza sul campo molto maggiore. La separazione - ribadisce - non e' un fatto banale, ma e' un momento rivoluzionario della vita di chiunque sotto il profilo sia affettivo sia patrimoniale'. In piu', aggiunge, 'si corre il rischio che il piu' 'potente' e il piu' ricco tra i due coniugi obblighi l'altro ad andare da un notaio per chiudere, magari anche con un ricatto'.
Insomma per l'avvocatessa 'non ci si puo' improvvisare da un giorno all'altro giudici della separazione. C'e' un archivio di emozioni che non puo' essere trascurato e ci vogliono competenze ed esperienze. Pertanto - conclude - non vanno bene ne' i notai e nemmeno gli avvocati che si occupano di altre materie.
Altrimenti si va incontro ad equivoci, prendono spazio la voglia di litigare e le incomprensioni tra marito e moglie', con le conseguenze che cio' comporta, perche' mettere fine a un matrimonio non e' come sottoscrivere 'un rogito'. (ANSA).

ROMA — La separazione dal notaio anziché in tribunale, ma solo se non ci sono «minori da tutelare». È una delle ipotesi per snellire la giustizia civile alla quali lavoreranno nelle prossime settimane il ministro per la Giustizia, Angelino Alfano, e il Consiglio nazionale del notariato (cioè l’organo di autogoverno della categoria). Ieri il Guardasigilli è stato l’ospite d’onore della prima riunione del nuovo Consiglio dei notai: ha simbolicamente presieduto i lavori. E ha lanciato la proposta: istituire un tavolo di «consultazione permanente con il notariato per individuare soluzioni per il funzionamento della giustizia civile».

Tradotto: individuare nuove competenze da assegnare ai notai per alleggerire il lavoro dei magistrati civili. Fra queste, appunto, ci potrebbe essere in tempi ragionevolmente brevi «la composizione patrimoniale nel caso delle separazioni senza figli», cioè l’attribuzione dei beni fra marito e moglie. E, con un intervento legislativo più complesso, ma «se c’è la volontà nel giro di qualche mese », anche l’intera separazione dal notaio. Il percorso è stato illustrato da Giancarlo Laurini, presidente del Consiglio dei notai. «I dati dimostrano che laddove come categoria siamo stati chiamati a coadiuvare i giudici, le cose hanno funzionato bene: mi riferisco per esempio al controllo degli atti societari, che ci è stato affidato nel 2000. E il contenzioso su queste materie non esiste. Diciamo che abbiamo una funzione preventiva. Il giudice risolve i conflitti decidendo, la nostra azione permette di prevenirli».

E dagli atti societari ai matrimoni in crisi, il passo potrebbe essere molto breve. «Noi siamo professionisti particolari, abbiamo un ruolo super partes, di controllo. Non rappresentiamo interessi di parte. Per questo sarebbe molto semplice affidarci il ruolo della composizione nelle separazioni», aggiunge il notaio Laurini. Del resto, i tempi di attesa nei tribunali sono spesso molto lunghi: 3 o 4 mesi solo per avere la prima udienza. E se—anche nel caso di separazioni consensuali— ci sono beni da spartire, i tempi possono allungarsi fra perizie e verifiche. Dal notaio i tempi potrebbero subire un sensibile accorciamento. E i costi? «In realtà non si tratterebbe di attività lucrose per noi. Mettiamo a disposizione le competenze e la professionalità per permettere ai tribunali civili di occuparsi di altre questioni», dice ancora il leader dei notai, spiegando di aver già parlato della questione con il ministro.

E da via Arenula, sede del dicastero della Giustizia, i tecnici confermano che «allo studio ci sono varie ipotesi per snellire le procedure civili, anche per le separazioni». L’ipotesi di affidare al giudice di pace le competenze per i conflitti fra marito e moglie è stata scartata perché—fra i motivi— rischierebbe di allungare i tempi, anziché accorciarli. «I notai, almeno per le questioni patrimoniali, hanno però le competenze adatte», aggiungono dal ministero. «All’estero ci sono Paesi nei quali l’intera separazione e anche il divorzio sono affidati ai notai », sottolinea Giancarlo Laurini, ricordando che «anche al seguito di Cristoforo Colombo c’era un notaio mandato dalla regina di Spagna per certificare la presa di possesso delle nuove terre». Figuriamoci se può essere un problema certificare la fine di un amore.
